DEA Schedules Hearing On Marijuana Rescheduling, Delaying Reform Until After Election

The Drug Enforcement Administration (DEA) has agreed to hold an administrative hearing regarding the rescheduling of cannabis as a Schedule III drug under the Controlled Substances Act (CSA).

The Department of Justice (DOJ) received over 40,000 submissions during a 60-day public comment period after moving to reclassify cannabis in March. The hearing, which will be held Dec. 2, will allow DEA to consider differing expert opinions on the proposal to reschedule cannabis.

With the announcement of the hearing, the DEA explained that interested parties that may be “adversely affected or aggrieved” by the policy change must submit a notice of intent to participate in the hearing to the agency within 30 days of the formal publication of this filing.
